TURNING THE SHIELD INTO A SWORD: USING THE NHTSA MANUAL TO CROSS EXAMINE THE DEFENSE EXPERT

If you prosecute DUI cases you have seen a defense attorney attack a police officer’s administration of the standardized field sobriety tests. Sometimes defendants even hire expert witnesses, who may or may not qualify as experts, to analyze police reports and dash cam videos to look for any mistake in the SFSTs, no matter how slight. Cases can be lost when this type of testimony goes unchallenged.
What prosecutors don’t always realize is that there is a ton of good stuff in the NHTSA Manual that can be used to support your officer’s SFST testimony and, more importantly, that can be used to gain concessions from the defense witness. For instance, the manual states that slowed reactions commonly begin at .03 and increased risk taking begins at .05.
Defendants like to use the NHTSA Manual as a shield to avoid responsibility for their poor decisions and dangerous behavior. This webinar will show you how to use the Manual as a sword to attack the defense expert, defend your officer and win your impaired driving case.
Tom Kimball, the Tennessee Traffic Safety Resource Prosecutor, and Sergeant Joe Armistead, an instructor with the training division of the Missouri State Highway Patrol, will be the instructors for this program.
